TERMS AND CONDITIONS OF SERVICE AGREEMENT

These Terms and Conditions govern the relationship between HHD Travel Group LLC dba Emerald Luxury Travel (“Emerald Luxury Travel,” “we,” or “us”) and the traveler (“Client”). By engaging Emerald Luxury Travel to arrange travel services or by paying any invoice issued by Emerald Luxury Travel, Client acknowledges that they have read, understood, and agree to these Terms and Conditions. Payment of any invoice issued by HHD Travel Group LLC dba Emerald Luxury Travel constitutes acceptance of these Terms and Conditions.
1. Agent for Suppliers. HHD Travel Group LLC dba Emerald Luxury Travel acts solely as a travel advisor and intermediary for travel suppliers including but not limited to airlines, hotels, cruise lines, tour operators, destination management companies, transportation providers, and other travel service providers (“Suppliers”). Emerald Luxury Travel does not own, operate, manage, or control any Supplier. Client consents to the use of such Suppliers and agrees that Emerald Luxury Travel shall not be responsible for any act, omission, error, delay, injury, loss, accident, damage, or inconvenience caused by a Supplier. Client agrees not to hold Emerald Luxury Travel liable should any Supplier:
• fail to provide services purchased
• fail to comply with applicable laws
• modify or cancel travel services
• change schedules, routing, or accommodations
• fail to honor future travel credits or vouchers
Emerald Luxury Travel has no special knowledge regarding the financial condition of Suppliers and shall not be responsible for Supplier insolvency or failure to deliver services.
2. Merchant of Record. Client acknowledges that Emerald Luxury Travel acts as an intermediary arranging travel services with independent third-party Suppliers. In many cases, travel Suppliers are the merchant of record and are responsible for delivering the services purchased. Payments processed by Emerald Luxury Travel may be collected on behalf of the Supplier and remitted to the Supplier for the travel services purchased.
3. Supplier Terms and Policies. Travel Suppliers maintain their own terms and conditions governing reservations, cancellations, refunds, changes, and service delivery. Client acknowledges that all bookings arranged through Emerald Luxury Travel are non-refundable unless explicitly stated otherwise in writing by Emerald Luxury Travel on the Client’s invoice or written booking confirmation. Where a supplier provides a specific cancellation or refund policy, that supplier policy shall govern. Client agrees to comply with all Supplier policies applicable to their reservations. Emerald Luxury Travel does not control supplier policies and shall not be responsible for any cancellation penalties, refund limitations, or policy changes imposed by suppliers.
4. Risks of Travel. Travel involves inherent risks including but not limited to illness, injury, accidents, delays, mechanical failures, weather events, natural disasters, political instability, airline disruptions, or other unforeseen circumstances. Emerald Luxury Travel has no special knowledge regarding unsafe conditions, health hazards, weather hazards, political instability, or security risks at travel destinations. For information concerning possible dangers at destinations, we recommend reviewing the Travel Warnings Section of the U.S. State DepartmentWebsite or calling (202) 647-5225. To review the Travel Warnings Section of the U.S. State DepartmentWebsite, go to: http://www.travel.state.gov/, click on “Find International travel Information” then click on“Country Information”, and fill in the name of the destination country. For medical information, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel and click on “Destinations”. Client assumes full responsibility for reviewing travel advisories issued by government authorities including the U.S. Department of State and the Centers for Disease Control. CLIENT HEREBY RELEASES EMERALD LUXURY TRAVEL FROM ALL CLAIMS ARISING FROM RISKS ASSOCIATED WITH TRAVEL.
5. Client Decision to Travel
Emerald Luxury Travel may provide information, recommendations, or advisories regarding travel conditions; however, the final decision to travel rests solely with the Client. If Client elects to travel despite travel advisories, government warnings, or other known risks, Client assumes full responsibility for that decision. Client acknowledges that Emerald Luxury Travel does not control travel conditions and cannot guarantee the safety, stability, or uninterrupted operation of travel services.
Emerald Luxury Travel shall not be liable for any loss, injury, delay, cancellation, or inconvenience arising from Client’s decision to travel under such circumstances.
6. Travel Documentation, Client is solely responsible for obtaining and maintaining proper travel documentation including but not limited to passports, visas, vaccination records, entry permits, customs documentation, and government-issued identification. Many countries require that passports remain valid for at least six months beyond the scheduled return date. Failure to obtain proper documentation may result in denied boarding or denied entry, for which Emerald Luxury Travel bears no responsibility. Client agrees to review all travel documents upon receipt and notify Emerald Luxury Travel immediately of any errors.
7. Passports, Visas, and Government Requirements. Emerald Luxury Travel may provide general guidance regarding travel documentation requirements; however, Emerald Luxury Travel does not provide legal or immigration advice and is not responsible for communicating directly with embassies, consulates, or government agencies on behalf of the Client. Client is solely responsible for completing and submitting all required government applications, forms, or documentation and for verifying entry requirements for all destinations and transit points. Emerald Luxury Travel shall not be responsible for any loss, delay, denied boarding, denied entry, fines, penalties, or additional costs resulting from incomplete or incorrect travel documentation.
8. Price Changes. Travel prices are subject to change until reservations are confirmed and ticketed. Post-purchase price increases may occur due to:
• fuel surcharges
• taxes or government fees
• currency exchange fluctuations
• supplier-imposed increases
Client authorizes Emerald Luxury Travel to charge Client’s payment method for such increases where applicable.
9. Credit Card Authorization. By providing a credit card for payment, Client certifies that they are an authorized user of the card and authorizes Emerald Luxury Travel to charge the card for travel services arranged on Client’s behalf. Client authorizes charges for deposits, scheduled payments, final balances, supplier charges, and applicable service fees. Client agrees not to initiate a chargeback for authorized charges related to travel services arranged by Emerald Luxury Travel and agrees to contact Emerald Luxury Travel directly to resolve any billing disputes.
10. Travel Insurance. Emerald Luxury Travel strongly recommends the purchase of comprehensive travel insurance. Travel insurance may provide coverage for: trip cancellation, trip interruption, medical emergencies, evacuation, travel delays, baggage loss Client is responsible for reviewing the coverage terms and limitations of any insurance policy purchased.
11. Fee Structure. Emerald Luxury Travel provides customized travel planning services and charges professional service fees based on the complexity and scope of the trip. Planning fees compensate Emerald Luxury Travel for research, itinerary development, supplier coordination, booking management, and client support. All planning and service fees are non-refundable once services have commenced. Invoices not paid prior to travel may be charged to the Client’s credit card on file. Price quotes are applicable to the date and time they are provided and are subject to change until confirmed. Quotes in foreign currency are subject to fluctuations in exchange rates and international credit card issuer fees.
12. Cancellation and Post-Booking Changes. Once travel arrangements have been confirmed with suppliers, cancellations or significant itinerary changes may result in penalties imposed by the applicable suppliers. If Client cancels a confirmed booking, Emerald Luxury Travel will make reasonable efforts to assist in obtaining any refunds, credits, or alternate arrangements where permitted by the applicable supplier. However, all refund decisions remain solely at the discretion of the travel supplier, and Emerald Luxury Travel does not guarantee that refunds or credits will be available. A $250 administrative cancellation fee will apply to any confirmed booking that is cancelled after confirmation, in addition to any penalties imposed by suppliers. If Client requests substantial changes to a confirmed itinerary, Emerald Luxury Travel reserves the right to charge additional planning or administrative fees. Additional planning or itinerary revision fees may apply for substantial itinerary changes after bookings have been confirmed.
13. Force Majeure. Emerald Luxury Travel shall not be liable for any loss, delay, inconvenience, or damage caused by circumstances beyond its control including but not limited to:
• acts of God
• natural disasters
• pandemics
• government actions
• travel restrictions
• airline disruptions
• labor disputes
• weather conditions
• civil unrest
• terrorism
In such circumstances refunds or credits are subject solely to supplier policies.
14. Itinerary Changes and Missed Services. Travel schedules, itineraries, and service availability may change due to circumstances beyond the control of Emerald Luxury Travel. Emerald Luxury Travel is not responsible for missed flights, transfers, tours, excursions, cruise embarkations, reservations, or other services resulting from delays or disruptions caused by airlines, suppliers, or other third parties. Client acknowledges that travel services often operate on fixed schedules and failure to arrive on time may result in forfeiture of the service without refund.
15. Travel Disruptions, Missed Services, and Emergency Assistance. Travel schedules and itineraries may be affected by circumstances beyond the control of Emerald Luxury Travel. Emerald Luxury Travel strongly recommends the purchase of travel insurance. In the event of travel disruptions or missed services, Client should notify their insurance provider immediately and follow the insurer’s procedures for filing a claim. If travel insurance was not purchased, Client assumes full financial responsibility for any missed services or additional costs. During travel, if Client misses a connection, transfer, tour, or other scheduled service, Client is responsible for arranging alternate transportation or making arrangements to reach the next scheduled destination. For certain itineraries, Emerald Luxury Travel or its travel partners may provide a 24-hour emergency contact number for assistance. If provided, Client must notify the emergency contact or supplier as soon as reasonably possible following any disruption. Failure to promptly notify the emergency contact or supplier may limit the ability to modify travel arrangements or recover missed services. Any itinerary changes remain subject to supplier availability and may result in additional charges. Emerald Luxury Travel does not guarantee that missed services can be recovered, rescheduled, or refunded.
16. Limitation of Liability. To the fullest extent permitted by law, the liability of HHD Travel Group LLC dba Emerald Luxury Travel shall be limited to the amount of professional planning fees paid to the agency. Emerald Luxury Travel shall not be liable for indirect, consequential, or incidental damages including loss of enjoyment, emotional distress, or missed travel experiences.
17. Claims Deadline. Client agrees to present any claims against Emerald Luxury Travel within 30 days after completion of travel. Any legal action must be filed within one year of the incident giving rise to the claim.
18. Governing Law and Jurisdiction. These Terms and Conditions shall be governed by the laws of the State of Oregon. Client agrees that any disputes arising from services provided by HHD Travel Group LLC dba Emerald Luxury Travel shall be resolved exclusively in the courts located within the State of Oregon.
19. Authority to Agree. The person accepting these Terms and Conditions represents that they have the authority to accept these Terms on behalf of all travelers included in the reservation. All travelers listed on the itinerary are bound by these Terms and Conditions.
